Terms of Use

1. Acceptance of conditions

This User Agreement is a legal agreement between GS Games and you. By using the “GS Games” application (“Application”), you agree that you have read and accepted these terms. GS Games reserves the right, at its sole discretion, to modify this Agreement at any time, and you agree to such changes. Any change takes effect after publication, and your continued use of the Application after any changes will signify your acceptance of these changes. If you disagree with any changes, you can stop using the application.

2. Rights to use the application

If you agree to these terms, the GS Games application grants you a limited, non-exclusive, non-transferable and non-sublicensable right to use and access the application solely for non-commercial use. You agree not to use the application for other purposes except as provided in this Agreement, you may not copy, adapt, modify, create derivative works based on the application, distribute, sell and transfer the application or any part of it for use by other persons, except cases provided for in this Agreement. In accordance with the intellectual property rights, the license and the rights to the application are not granted to you either indirectly or under the control of the GS Games application, except as otherwise provided for in this Agreement.

If you violate these conditions, GS Games reserves the right to warn you about the violation, to immediately remove or suspend the accounts you have created using the Application. By reading this Agreement you confirm that “GS Games” has the right to suspend your account or delete it without notice. GS Games reserves the right to deny any user access to the application without prior notice for any reason, but without violating these terms of the Agreement.

3. Intellectual property

All rights, title and access to all materials that are part of the Application (including: design, text, graphics, photos, video, information, applications, software, music, sound and other files, as well as their selection and location), collectively referred to as you and “GS Games” as “Application Materials,” are the property of “GS Games” and / or its third-party licensors, with the exception of “User Content”. In accordance with this Agreement, you acknowledge and agree that you do not acquire ownership rights by downloading the “Application Materials”.

You agree that you do not have the right to change, copy, distribute, reproduce, republish, upload, post, transmit or sell the "Materials of the Application" in any form, in whole or in part, or otherwise use the "Materials of the Application" without prior written permission "GS Games". All other uses of copyrighted materials also require prior written permission from GS Games. Any reproduction or distribution of the “Materials of the Application” that do not comply with these Terms and Conditions is prohibited and may entail civil and criminal liability. You acknowledge that you do not receive any ownership rights to the “Application Materials” and their derivatives from “GS Games”. All rights not specified in this Agreement are reserved by GS Games and its licensors, and no license is hereby granted directly or indirectly.

4. User Content

Any data, text, graphics, photographs and their selection and location, as well as any other materials downloaded to the Application by you or other users (hereinafter “User Content”) are to be used for commercial, non-commercial and / or promotional activities “GS Games ". Persons from whom the User Content originates are solely responsible for it. Thus, users are responsible, and GS Games is not responsible for any files uploaded by the Users. “GS Games” may regulate, as well as not regulate the content of User Content, and does not guarantee the accuracy, quality and integrity of User Content hosted using the “GS Games” application. Using the Application, you acknowledge and agree that you may encounter materials that may be considered offensive or undesirable. You agree that “GS Games” shall not, under any circumstances, be liable for User Content and any loss or damage caused to you by using this content.

User content is not confidential information and the right to its property is not returned to the user. You submit User Content and warrant that you transfer the rights to its use and content, including the right to grant all the rights and licenses of “GS Games” without any obligations of third parties or liability arising from such rights and licenses. You thereby grant GS Games a worldwide, irrevocable, perpetual, non-exclusive, transferable right and a royalty-free license (with sublicensing rights) for using, copying, adapting, modifying, distributing, licensing, selling, transmitting or otherwise using User Content that you transfer to "GS Games". To the extent permitted by applicable law, you waive the ownership of the User Content. GS Games reserves the right to permanently remove any User Content from the application with or without notice for any reason or no reason. You may notify GS Games of the content of any User Content or inappropriate behavior of users who, in your opinion, violate this Agreement, via email at [email protected].

5. Rules of conduct/use

The application may provide communication channels designed to communicate with other users of the application. “GS Games” is not obliged to monitor these communication channels; the Application also reserves the right to view materials posted on communication channels and delete any materials (including, without limitation, User Content) at any time, with or without notice reasons for deletion, in its sole discretion. GS Games may also terminate or suspend access to any communication channels at any time, without prior notice, for any reason. You acknowledge that any User Content (including chats, publications, or materials posted by users) on communication channels are not subject to control by GS Games. “GS Games”, under no circumstances, is not responsible for the activity in the communication channels.

As a condition of your use of the Application, you agree to abide by the restrictions and rules of use set forth in this section, as well as any additional restrictions or rules (for example, the rules of a particular application) set forth in this application. In continuation of the above, you agree:

• not to post, not to distribute, not to transmit information of obscene, vulgar, pornographic, sexual and other unacceptable nature;
• not to use the Application for the purposes of slander, ridicule, harassment, threats, intimidation of other users on ethnic, racial or other grounds;
• not to use the Application for the purpose of disseminating personal information, infringement of intellectual property rights of any of the parties through use, downloading, transferring or other actions carried out in any manner through the Application, which violate copyrights, trademarks, patents, trade secrets, or other right any from the parties (including the right to privacy);
• not to use the Application to attempt to obtain passwords or other personal information of other participants;
• do not use communication channels or complaint buttons to leave false testimony for GS Games;
• do not use cheats, exploits, bots, hacks, mods or any other unauthorized third-party software in order to interfere with the Application or any other “GS Games” gaming product;
• not to use the Application for the purpose of developing or assisting in the development of cheats, exploits, bots, hacks, mods or any other unauthorized third-party software in order to interfere with the Application or any other GS Games gaming product;
• not to use the Application for the purpose of changing or modifying any files that are part of the Application, without the written consent of “GS Games”;
• do not destroy, overload or provide assistance in destroying or overloading (1) any computer or server used to maintain the Application or any other GS Games gaming environment (the “Server”); or (2) not to use the Application or any other GS Games gaming environment from another person;
• not to participate in any type of virus attack on the Application and in other attempts to interrupt the use of the Application for other persons;
• do not attempt to gain unauthorized access to the Application, the accounts of other users registered in the Application, servers, or networks connected to the Application and GS Games, including, not to try to facilitate any other person, to gain access to technology, device or software that is part of the Application;
• not interfere or attempt to interfere with the proper functioning of the Application or connect or use the application for purposes not expressly permitted by these Terms of Use;
• do not use unauthorized third-party software that allows you to access, intercept, or otherwise collect information from the Application, including any software that reads RAM areas or network traffic flows of the Application;
• it is prohibited to intercept, verify, or otherwise monitor the private communication protocol used by the client by using a network analyzer, packet sniffer or other device;
• it is forbidden to automate the use of the system, or to take any actions that impose or may impose (at our discretion) an excessive or disproportionately large load on our infrastructure;
• it is prohibited to use, create or maintain any unauthorized connection to the Application, including: (1) unauthorized connection of any server that emulates or attempts to emulate any part of the Application; or (2) any connection using software, tools or software not approved by GS Games;
• it is forbidden to use, distribute or publicly report to others any mistake of the game that gives unintended advantages;
• it is prohibited to violate any applicable laws or regulations, or to encourage any illegal activity, including: hacking, distributing unlicensed software, or cheats and hacks for the Application.

These data are not exhaustive, and “GS Games” reserves the right to determine what behavior is a violation of the Agreement or improper use of the Application, as well as to take action until your account is terminated and excluded from further participation in the Application.

6. Termination

You can close your account at any time and for any reason by sending an email to [email protected]. “GS Games” can stop your account and your access to the Application (or, at the discretion of “GS Games”, to the relevant parts of the application) at any time and for any reason. “GS Games” is not required to provide you with any notice or warning to stop the account’s validity.
